NOTICE OF SPECIAL ASSESSMENT PUBLIC HEARING
LITTLE FISH LAKE WEED AND AQUATIC PLANT CONTROL 2025 – 2029
TO: THE RESIDENTS AND PROPERTY OWNERS OF VOLINIA TOWNSHIP,
CASS COUNTY, MICHIGAN AND ANY OTHER INTERESTED PERSONS:
PLEASE TAKE NOTICE that upon motion of the Township Board, as authorized by PA 188 of
1954, as amended, the Township Board proposes to undertake an aquatic plant control project
(with associated activities) in Little Fish Lake in Volinia Township (including all lands with
frontage on Little Fish Lake in Volinia Township) as more particularly described below, and to
create/recreate/continue a special assessment district for the recovery of the costs thereof by
special assessment against the properties benefitted.
PLEASE TAKE FURTHER NOTICE that the special assessment district within which the
foregoing improvements are proposed to be made and within which the costs thereof are to be
specially assessed is more particularly described as “all of those properties in Volinia Township,
Cass County, Michigan with frontage on Little Fish Lake”.

PLEASE TAKE FURTHER NOTICE that the Township Board has received plans showing the
proposed aquatic plant control project, associated activities, any proposed improvements and
locations thereof, together with an estimate of the cost of the project. The Township Board
proposes to renew said special assessment district and to carry any collected but unused
remaining funds in the existing Little Fish Lake Special Assessment into the renewed/new
district.
PLEASE TAKE FURTHER NOTICE that the Township Board has placed the project plans and
costs estimates on file with the Township Clerk and said plans, cost estimates and special
assessment district may be examined at the Clerk’s office from the date of this Notice to the
date of the public hearing and may further be examined at such public hearing.
PLEASE TAKE FURTHER NOTICE that the Township Board proposes to make a per-parcel
special assessment each year for a period of five years (2025 – 2029 inclusive) in an amount to
be determined periodically, which amount will be based on the scope of work planned for that
year. The annual assessment is proposed to range between $14,000 to $16,000 per year,
which will be split between all of the parcels in the district.
Additionally, the Township Board reserves the right to not levy an assessment or to levy a lesser
assessment amount in any year that there are more funds in the special assessment fund than
the amount needed for that year’s aquatic plant control work and associated activities. The
Township Board proposes to annually assess benefited properties for the costs of the aquatic
plant control project (with associated activities), with only published notice each year, unless the
amount to be specially assessed increases by more than 10% in any one year. If the amount
to be specially assessed increases by more than 10% in any one year, then mailed notices of
the public hearing on the reassessment would be provided to owners of record of property to be
specially assessed.
PLEASE TAKE FURTHER NOTICE that a public hearing on the plans, district, and cost
estimates for the 2025-2029 Little Fish Lake Aquatic Weed Control Special Assessment District
will be held at the Volinia Township Hall at 53254 Goodenough Rd., Marcellus, MI 48197 at
7:30 pm on July 14, 2025.

At the hearing, the Board will consider any written objections and comments to any of the
foregoing matters which are filed with the Clerk at or before the hearing, and any objections or
comments raised at the hearing; and at the hearing (or any adjournment of the hearing which
may be made without further notice), the Township Board may revise, correct, amend or change
the plans, cost estimates or special assessment district.
PLEASE TAKE FURTHER NOTICE that if written objections to the project are filed with the
Township Board at or before the hearing, signed by the record owners of land constituting more
than 20% of the area within the proposed special assessment district, then the Township Board
may not proceed unless petitions in support of the project, signed by record owners of more
than 50% of the area to be made into a special assessment district, are filed with the Township.
Written comments or objections may be filed with the Clerk at the address set out below.
PLEASE TAKE FURTHER NOTICE that appearance and protest at the public hearing is
required in order to appeal the amount of the special assessment to the State Tax Tribunal
within 30 days after the special assessment roll is confirmed.
An owner or party in interest, or his or her agent, may appear in person at the hearing to protest
the special assessment, or shall be permitted to file at or before the hearing his or her
appearance or protest by letter and his or her personal appearance shall not be required. All
interested persons are invited to be present in person or by representative and to submit
comments concerning the establishment of the special assessment district, the plans, and cost
estimates.
PLEASE TAKE FURTHER NOTICE that if the Township Board determines to proceed with the
special assessments, it will cause a special assessment roll to be prepared and another hearing
will be held, after notice to record owners of property proposed to be specially assessed, to hear
public comments concerning the proposed special assessments.
Volinia Township will provide necessary reasonable auxiliary aids and services, such as signers
for the hearing impaired and audio tapes of printed material being considered at the hearing, to
individuals with disabilities at the hearing upon four (4) days’ notice to the Volinia Township
Clerk. Individuals with disabilities requiring auxiliary aids or services should contact the Volinia
Township Clerk.
